A Board of Health inspection found mold in the bedroom. The inspector found that the leaky pipes caused the mold. Jane's asthma is worsened by her allergy to mold. Mold can cause a restriction of her airways, which can lead to hospitalization or death.

The Board of Health requires that all leased housing be free of chronic dampness. This apartment is not free of chronic dampness. The mold in the apartment, therefore, violates the law against chronic dampness in addition to significantly worsening Jane's health.

Contoh Kasus Persaingan Usaha

Chevron Divonis Denda Rp 2,5 Milyard

JAKARTA. Raksasa perusahaan minyak Chevron Indonesia Company divonis bersalah melakukan tindakan diskriminasi dalam tender export pipeline front end enggineering & design contract. Komisi Pengawas Persaingan Usaha (KPPU) menghukum Chevron membayar denda sebesar Rp 2,5 miliar.

“Menyatakan bahwa terlapor I (Chevron) terbukti secara sah dan menyakinkan melanggar Pasal 19 Huruf D Undang-Undang Nomor 5 Tahun 1999,” kata Ketua Majelis Komisi Muhammad Nawir Messi, Kamis (16/5).

Dalam Pasal 19 Huruf d disebutkan pelaku usaha dilarang melakukan satu atau beberapa kegiatan, baik sendiri maupun bersama pelaku uasaha lain yang dapat mengakibatkan terjadinya praktek monopoli atau persaingan usaha tidak sehat berupa melakukan praktek diskriminasi terhadap pelaku usaha tertentu.

Sementara itu, Majelis Komisi juga memutuskan bahwa PT Worley Parsons Indonesia (terlapor II) tidak terbukti melanggar Pasal 19 Huruf D UU No. 5 Tahun 1999. Chevron disebutkan melakukan praktek diskriminasi terhadap peserta tender lainnya yakni PT Wood Group Indonesia. Sementara itu, Chevron telah menetapkan PT Worley Parsons (terlapor II) selaku pemenang tender.

Terkait putusan ini, Stefanus Haryanto, Kuasa Hukum Chevron, enggan untuk memberikan komentarnya. “No comment ya,” katanya. Hal serupa juga disampaikan oleh Mochmad Fachri selaku kuasa hukum Worley Parsons.

Perkara ini berawal dari penyelidikan terhadap Resume Monitoring KPPU RI mengenai adanya Dugaan Pelanggaran Pasal 19 huruf d dan Pasal 22 Undang-Undang Nomor 5 Tahun 1999 pada Dugaan Pelanggaran Undang-Undang Nomor 5 Tahun 1999 terkait dengan Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company, yang dilakukan oleh Chevron Indonesia Company sebagai Terlapor I dan PT Worley Parsons Indonesia sebagai Terlapor II.

Objek perkara ini adalah Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company dengan total estimate contract value sebesar 4.690.058 US$. Tender ini menggunakan sistem pemasukan penawaran dua tahap berdasarkan PTK 007 Revisi 1 Tahun 2009, yang terdiri dari tahap teknis dan tahap komersial.

 

Analisis Contoh Kasus di atas

A. Analisa Bukti
Dari penjelasan Kasus diatas dapat di analisa raksasa perusahaan minyak Chevron Indonesia Company divonis bersalah melakukan tindakan diskriminasi dalam tender export pipeline front end enggineering & design contract. Dan perusahaan minyak Chevron disebutkan melakukan praktek diskriminasi terhadap peserta tender lainnya yakni PT Wood Group Indonesia. Sementara itu, Chevron telah menetapkan PT Worley Parsons (terlapor II) selaku pemenang tender.

B. UU yang berlaku
Dalam kasus ini UU yang dikenai Pasal 19 Huruf D Undang-Undang Nomor 5 Tahun 1999. Dalam Pasal 19 Huruf  D disebutkan “Pelaku usaha dilarang melakukan satu atau beberapa kegiatan, baik sendiri maupun bersama pelaku usaha lain, yang dapat mengakibatkan terjadinya praktek monopoli dan atau persaingan usaha tidak sehat berupa melakukan praktek diskriminasi terhadap pelaku usaha tertentu.”

C. Hukuman yang Berlaku

Dalam kasus di atas dapat dilihat dari UU (Undang-Undang Nomor 5 Tahun 1999) yang berlaku maka pelaku dapat hukuman pidana denda serendah-rendahnya Rp 25.000.000.000,00 (dua puluh lima miliar rupiah) dan setinggi-tingginya Rp 100.000.000.000,00 (seratus miliar rupiah), atau pidana kurungan pengganti denda selama-lamanya 6 (enam) bulan.

E. Objek Perkara

Objek perkara ini adalah Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company dengan total estimate contract value sebesar 4.690.058 US$. Tender ini menggunakan sistem pemasukan penawaran dua tahap berdasarkan PTK 007 Revisi 1 Tahun 2009, yang terdiri dari tahap teknis dan tahap komersial.

E. Tanggapan
Dari Kasus tersebut saya menanggapi bahwa undang-undang larangan praktik monopoli dan persaingan usaha tidak sehat itu perlu karena kita tidak ingin perekonomian negara ini hanya dikuasai oleh segelintir orang atau pengusaha yang memiliki pangsa pasar yang monopolistis dan persaingan tidak sehat lainnya. Dan Komisi Pengawas Persaingan Usaha (KPPU) sebagai lembaga yang mengawasi tentang persainagn usaha harus tegas terhadap perusahaan-perusahan besar ataupun kecil yang melakukan tindakan monopoli. Supaya tidak terjadi kesenjangan sosial yang amat dalam antara penduduk Indonesia

Contoh Kasus Persekongkolan Donggi-Senoro Bisa Rusak Iklim Investasi

Jakarta -Kasus persekongkolan tender proyek Donggi-Senoro diyakini akan merusak iklim investasi sektor migas di Tanah Air. Meskipun saat ini pihak Komisi Pengawas Persaingan Usaha (KPPU) telah menjatuhkan sanksi denda terhadap pelanggaran persekongkolan tersebut.
Kuasa hukum anak usaha PT LNG International Pty Ltd yaitu LNG Energi Utama, OC Kaligis mengatakan persekongkolan yang dilakukan pihak Mitsubishi Corporation, PT Pertamina, PT Medco Energi International, dan PT Medco E&P Tomori Sulawesi untuk menyingkirkan PT LNG Energi Utama atas proyek Donggi-Senoro dapat memberikan contoh buruk untuk investasi Migas Indonesia ke depannya.

"Ini merupakan contoh buruk tentang iklim investasi di Indonesia karena tidak adanya perlindungan hukum atas terjadinya masalah ini," katanya di acara konferensi pers yang dilaksanakan di restoran Sari Kuring, Jakarta (11/4/2011).
OC Kaligis mengatakan bahwa terjadi pembocoran rahasia PT LNG Energi International pty Ltd kepada pihak Mitsubishi.

Di tempat yang sama, Rikrik Rizkiyana rekan OC Kaligis  mengatakan bahwa proyek Donggi-Senoro yang sudah berjalan tersebut sebaiknya dibekukan terlebih dahulu sampai ada keputusan hukum tetap.
"Kita akan lakukan upaya hukum, serta gugatan perdata untuk perbuatan melawan hukum dan juga persaingan tidak sehat," kata Rizkiyana.

PT LNG Energi Utama, selaku anak perusahaan LNG International Pty. Ltd menuntut pihak Mitsubishi Corporation atas ganti rugi sebesar US$ 709 juta akibat adanya persekongkolan dari pihak Mitsubishi Corporation, PT Pertamina (persero), PT Medco Energi International, serta PT Medco E&P Tomori Sulawesi.

Pihaknya telah mengirimkan surat somasi kepada Mitsubishi Corporatioan yang pada pokoknya meminta pihak Mitsubishi Corporation untuk dengan itikad baik segera  memberikan ganti rugi kepada LNG International Pty Ltd dan Energi Utama atas segala kerugian yang telah diderita.
Dari sisi pemerintah melalui Kementerian ESDM menganggap sanksi denda yang diberikan oleh KPPU kepada Medco dan Pertamina sudah pantas. Hal ini tidak akan mengganggu investasi migas di Indonesia.
"Kalau untuk saya itu hanya konsekuensi dari tindakaan tidak fair saja dan mereka disuruh bayar denda ke negara. Kalau untuk proyek (Donggi-Senoro) kan KPPU tetap minta supaya tetap jalan. Jadi tak ganggu investor sepertinya," kata Dirjen Migas Evita Legowo beberapa waktu lalu.

Seperti diketahui sebelumnya, Majelis KPPU menyatakan telah terjadi persaingan usaha tidak sehat di proyek Donggi-Senoro. Untuk itu, KPPU menghukum seluruh pihak yang terlibat masing-masing membayar denda dengan total nilai Rp 31 miliar yang harus disetor kepada kas negara. Adapun rincian pembagian denda tersebut adalah, Pertamina Rp 10 miliar, Medco Energi Rp 5 miliar, Medco E P Tomori Rp 1 miliar, dan Mitsubishi Corp Rp 15 miliar. KPPU menemukan bukti terjadi persekongkolan oleh Mistusbishi dengan Medco Energi dan anak usahanya, Medco E P Tomori Sulawesi, untuk mendapatkan informasi kegiatan usaha pesaingnya yaitu LNGI yang diklasifikasikan sebagai rahasia perusahaan untuk menyusun proposal beauty contest.
